These Terms of Service ("Terms") govern your use of the website located at seniorsimple.io (the "Site") and any communications you receive from Senior Simple LLC ("we," "us," or "our"). By using the Site or submitting your information through our forms, you agree to be bound by these Terms.
1. Acceptance of Terms
By using the services provided by Senior Simple LLC, you agree to comply with and be bound by these Terms of Service. If you do not agree to these Terms, please do not use the Site or submit your information.
2. Service Description
Senior Simple provides ClientKeep, an enrollment and client management platform built for licensed independent insurance agents. The Site provides information about ClientKeep and allows you to request a demo, contact our support team, subscribe to our newsletter, or consent to receive SMS communications.
By using the Site, you may receive communications via email and, where you separately consent, text message regarding ClientKeep, product updates, and related offerings. You may opt out of these communications at any time as described in these Terms.
3. Communication Consent
By providing your contact information through our forms, you consent to receive communications from Senior Simple LLC related to your inquiry, account, and other information relevant to your relationship with us. These communications may be delivered via email, or, where you have separately provided consent, text message. Promotional or marketing messages will only be sent where you have separately provided consent. Message and data rates may apply for SMS communications.
4. SMS Terms and Conditions
Senior Simple offers an SMS messaging program for licensed independent insurance agents who have affirmatively consented to receive text messages. We do not text Medicare beneficiaries, consumers, or health plan enrollees.
Our SMS program is governed by the following terms:
- Consent. You consent to receive SMS messages by submitting your mobile number through the consent form on our SMS Consent page or the prize drawing entry form at seniorsimple.io/giveaway, and checking one or both of the consent boxes provided. Consent for marketing messages is collected separately from consent for account and service messages; you may give one without the other, and neither is a condition of purchase or of entering a drawing. We do not collect SMS consent through any other form on this Site.
- Message types. Messages may include product news, offers, and discount codes; invitations to demos, webinars, and events; product updates and feature announcements; account-related communications; onboarding, setup, and scheduling; billing and subscription information; and responses to HELP and recipient-initiated questions. We do not send third-party promotions or transmit protected health information by text.
- Message frequency. Message frequency varies. We anticipate low message volume. Brief periods of higher frequency may occur during product launches or time-sensitive account notifications.
- Fees. Senior Simple does not charge a fee for SMS messages. However, message and data rates may apply depending on your mobile carrier and plan. Check your carrier for details.
- Opt out. You may opt out at any time by replying STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any message. After we receive your opt-out request, you will receive a single confirmation message and no further SMS messages will be sent unless you opt back in. You may also email hello@seniorsimple.io to request removal.
- Help. Reply HELP or INFO to any message for program information and contact details. You can also reach us at hello@seniorsimple.io.
- Carriers. Mobile carriers are not liable for delayed or undelivered messages. Message delivery depends on your carrier's network availability and is not guaranteed.
- Privacy. Mobile phone numbers and SMS opt-in status are collected and stored in accordance with our Privacy Policy. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Mobile information is shared only with service providers strictly necessary to deliver the messages.

5. Privacy and Data Protection
We respect your privacy and handle personal information in accordance with our Privacy Policy. By using the Site, you agree to the collection, use, and disclosure of your information as described in that policy.
6. Opt-In and Opt-Out
User Opt-In. By providing your mobile phone number through an SMS consent form and checking one or both of the consent boxes provided, you voluntarily opt in to receive recurring SMS messages from Senior Simple LLC at the number provided, where permitted by applicable law and your consent preferences. You confirm that you are the owner or authorized user of the number provided. If your number changes, you agree to notify us promptly at hello@seniorsimple.io.
User Opt-Out. You may opt out of SMS messages at any time by replying STOP, QUIT, END, CANCEL, or UNSUBSCRIBE to any message. You may receive a final confirmation message acknowledging your opt-out. For help, reply HELP to any message.
Our messaging platform may not recognize requests that do not use supported keywords. While our messaging platform recognizes standard opt-out keywords, we make reasonable efforts to honor clear opt-out requests communicated through other means as well. If we change the phone number used for messaging, we will provide notice where required.
7. Intellectual Property
All content on the Site — including text, graphics, logos, images, and software — is the property of Senior Simple LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on the Site without our prior written consent.
8. Disclaimers
The Site and the information provided on it are made available on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, regarding the operation of the Site or the information, content, or materials included on the Site. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied.
9. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall Senior Simple LLC, its members, officers, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or any communications received from us.
10. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Harris County, Texas.
11. Changes to These Terms
We may update these Terms of Service from time to time. We will post any changes on this page and update the effective date above. Your continued use of the Site after such changes constitutes your acceptance of the updated Terms.
